Safer Recruitment of Management

Appointing the right person to a senior care role isn't only one of the most important decisions a provider will make, it's a legal one. Whether you're appointing a Registered Manager, Nominated Individual, Director, or Responsible Individual, CQC and Ofsted both set out specific fitness requirements that person has to meet before, and for as long as, they hold that role.

Our Safer Recruitment service helps you appoint the right people, the right way. We support you at every stage of the recruitment process, from role specification and advertising to shortlisting, interviewing, vetting, and onboarding. Every appointment is handled with the rigour that CQC and Ofsted expect and will hold up to scrutiny.

The Regulations Behind Safer Recruitment

Safer recruitment for management roles in care isn't just good practice, it's a specific legal requirement, and which regulation applies depends on whether you're CQC or Ofsted regulated.

If you're CQC regulated (adult social care)

Regulation 19, Fit and proper persons employed (Health and Social Care Act 2008 (Regulated Activities) Regulations 2014) applies to everyone you employ, requiring good character, the qualifications, competence, skills and experience necessary for the role, fitness to perform the work on health grounds, and recruitment procedures designed to check all of this. Schedule 3 of the same regulations sets out exactly what information you must hold on file for each person, identity checks, references, DBS checks, full employment history, and a health declaration among them.

Regulation 5, Fit and proper persons: directors goes further for Directors, Nominated Individuals, and equivalent board-level roles. On top of everything Regulation 19 requires, it adds that the individual must not have been responsible for, privy to, contributed to, or facilitated any serious misconduct, and that none of the grounds of unfitness set out in Schedule 4 apply to them.

If you're Ofsted regulated (children's homes)

Regulation 32, Fitness of workers (Children's Homes (England) Regulations 2015) requires recruitment procedures specifically designed to ensure children's safety, integrity and good character in every worker, and full, satisfactory information against every matter listed in Schedule 2 before that person starts.

Regulation 28, Fitness of manager sets a higher bar again for whoever manages the home: integrity and good character, at least 2 years' relevant residential childcare experience within the last 5 years, at least 1 year in a role supervising staff, and, within 3 years of starting in the role, the Level 5 Diploma in Leadership and Management for Residential Childcare (England), or a qualification the provider considers equivalent.

Getting any of this wrong isn't just a hiring mistake, it's a regulatory breach that can surface at your next CQC or Ofsted inspection, sometimes long after the appointment was made. That's exactly the gap this service is built to close.

How Each Part of This Service Satisfies the Regulations

1. Role Definition

We establish a clear position specification aligned to the regulatory requirements for the role, distinguishing what's needed for a Registered Manager under Ofsted's Regulation 28 experience and qualification thresholds from what's needed for a Director under CQC's Regulation 5, so the specification you recruit against is the right one from the outset.

2. Advertising & Sourcing

Professional job descriptions and targeted recruitment across care sector networks, written to attract candidates who genuinely meet the fitness requirements in Regulation 19 or Regulation 32, rather than candidates who look right on paper but fall short once vetted.

3. Shortlisting & Interviewing

Objective, structured interviews and panel support that test for the competence, skills, and experience Regulation 19, Regulation 5, Regulation 32, or Regulation 28 requires for the specific role, whichever applies, rather than a generic competency interview.

4. Vetting & Background Checks

Enhanced DBS checks, reference verification, qualification confirmation, right-to-work checks, and an employment gap analysis, directly building the evidence file Schedule 3 (CQC) or Schedule 2 (Ofsted) requires you to hold for that individual, so the paperwork is inspection-ready from day one, not assembled retrospectively when a regulator asks for it.

5. Onboarding & Registration

CQC or Ofsted notification support, induction planning, and fitness documentation, closing the loop by getting the regulatory notification made and the ongoing monitoring obligation, checking the person still meets the fitness requirements for as long as they hold the role, properly set up from the start.

Frequently Asked Questions

Do I need all four elements, or can I book just one?

You can book them individually. If you've already advertised and shortlisted candidates yourselves, for example, you might only need Interview Panel Support and Vetting & Background Checks, rather than the full process from role specification onwards.

What's included in Vetting & Background Checks?

Enhanced DBS checks, reference verification, qualification confirmation, right-to-work verification, and an employment gap analysis, the checks a Registered Manager, Nominated Individual, Director, or Responsible Individual needs to pass before appointment.

Do you help with notifying CQC or Ofsted once someone is appointed?

Yes, Regulatory Notification Support covers assistance with the CQC or Ofsted notification process, induction planning, and fitness documentation once a candidate has been vetted and appointed.

Does this service cover promoting an existing staff member into a management role?

Yes, it's designed for that as well as external recruitment, services promoting internal candidates into a Registered Manager or other regulated role still need the same vetting, role specification, and regulatory notification support.

What does CQC require when I recruit a Registered Manager, Director, or Nominated Individual?

Regulation 19, Fit and proper persons employed, requires good character, the necessary qualifications and experience, fitness on health grounds, and recruitment procedures that check all of this, with Schedule 3 setting out exactly what you must hold on file. Regulation 5, Fit and proper persons: directors, adds a stricter test for Directors, Nominated Individuals, and equivalent roles, including that the person hasn't been responsible for, or complicit in, serious misconduct.

What does Ofsted require when I recruit for a children's home?

Regulation 32, Fitness of workers, requires recruitment procedures designed to protect children, and full information against every matter in Schedule 2 before someone starts. Regulation 28, Fitness of manager, sets a higher bar for whoever manages the home: at least 2 years' relevant residential childcare experience in the last 5 years, at least 1 year supervising staff, and the Level 5 Diploma in Leadership and Management for Residential Childcare within 3 years of starting.

Do local authorities have their own safer recruitment standard?

There's no separate local authority regulation, local authorities work from the same Disclosure and Barring Service checking regime under the Safeguarding Vulnerable Groups Act 2006 that underpins Regulation 19 and Regulation 32. In practice, commissioning teams and provider approval frameworks expect to see evidence that this has been done properly before referring people to you or adding you to an approved list.
