Independent Investigation of Safeguarding Allegations

CQC and Ofsted both require safeguarding concerns to be investigated properly and acted on, immediately in CQC's case. Where the Registered Manager and Nominated Individual are the same person, or where a genuine conflict of interest exists, there's no independent senior figure inside the organisation to lead that investigation. You have a legal obligation is to investigate safeguarding concerns properly and take effective action, independence isn't written into the regulation itself the way it is for Ofsted's complaints regulation, it's what makes that investigation credible and defensible when the usual internal route is compromised.

Our impartial safeguarding investigation service provides the independent oversight that these situations demand, ensuring the investigation is credible, compliant, and safe. We will coordinate with other agencies where needed and produce a report that stands up to regulatory scrutiny.

The Regulation Behind Independent Safeguarding Investigation

If you're CQC regulated (adult social care)

Regulation 13, Safeguarding service users from abuse and improper treatment (Health and Social Care Act 2008 (Regulated Activities) Regulations 2014) requires you to have systems and processes that operate effectively to prevent abuse, and to investigate any allegation or evidence of abuse immediately on becoming aware of it. The regulation doesn't itself say who must carry out that investigation, the case for independence here comes from the practical reality that where the Registered Manager and Nominated Individual are the same person, there's no independent senior figure left inside the organisation to lead it credibly.

If you're Ofsted regulated (children's homes)

Regulation 12, The protection of children standard (Children's Homes (England) Regulations 2015) requires the home to "take effective action whenever there is a serious concern about a child's welfare," backed by Regulation 34, Policies for the protection of children, which requires the child protection policies that action is judged against to actually exist and be followed. As with CQC's Regulation 13, neither regulation mandates an independent investigator by name, but the same conflict of interest problem applies just as directly where the person who'd normally lead the response is the person the concern is about, or close to them.

When You Need This Service

Regulator or Commissioner Request

Where CQC, Ofsted, or a local authority safeguarding team has requested an independent investigation as part of their own enquiry or as a condition of ongoing registration.

Complex or Serious Concerns

Frequently Asked Questions

When would I need this rather than the Complaints Investigation service?

Use this service for a safeguarding concern rather than a complaint against management, particularly where the Registered Manager and Nominated Individual are the same person, meaning there's no independent senior figure internally to lead the investigation, or where a regulator or commissioner has specifically requested an independent safeguarding investigation.

What counts as a conflict of interest here?

Any situation where the person who would normally investigate has personal or professional ties to the subject of the concern, most commonly where the Registered Manager and Nominated Individual are one and the same, leaving no independent senior figure within the organisation to lead the investigation impartially.

Do you coordinate with other agencies, like the local authority safeguarding team?

Yes, the evidence gathering stage includes multi-agency coordination where relevant, alongside document review, structured interviews, and site visits, and the final report includes a regulatory assessment against the applicable CQC, Ofsted, or local authority framework.

Can you help present the findings to our board or regulator?

Yes, Findings Presentation support is available to help present the investigation's conclusions and recommendations to your board, commissioners, or a regulator, alongside the detailed written report itself.

What does CQC require when a safeguarding concern is raised?

Regulation 13, Safeguarding service users from abuse and improper treatment, requires systems that prevent abuse and investigate any allegation or evidence of abuse immediately on becoming aware of it. It doesn't itself name who must investigate, the case for independence comes from the practical conflict of interest where the Registered Manager and Nominated Individual are the same person.

What does Ofsted require for children's homes?

Regulation 12, The protection of children standard, requires the home to take effective action whenever there's a serious concern about a child's welfare, backed by Regulation 34, Policies for the protection of children, which requires the underlying child protection policies to exist and be followed. As with CQC's Regulation 13, neither names an independent investigator, but the same conflict of interest applies.

Do local authorities have their own duty to investigate safeguarding concerns?

Yes, a direct one. Section 42 of the Care Act 2014 requires a local authority to make whatever enquiries it thinks necessary whenever it has reasonable cause to suspect an adult with care and support needs is experiencing, or at risk of, abuse or neglect and is unable to protect themselves. This sits alongside your own duty under Regulation 13, a safeguarding concern can trigger both routes at once.
